17 Free Oklahoma Life & Health Practice Questions: Underwriting and Replacement (2026)

12 min read|Updated 2026-10-28

How to Use This Underwriting and Replacement Set

This set covers two outline sections together: Underwriting is 13 scored items and Considerations in Replacing Insurance is 2 on the combined Oklahoma exam, 15 of 150 in all. On the Life exam the pair is 20 and 2 of 100; on the Accident and Health or Sickness exam it is 10 and 3.

The questions follow a policy from the application to the delivery: how an application is completed and corrected, what a conditional receipt promises, how investigative reports work, what a producer does at delivery, and what counts as a replacement. Two Oklahoma numbers matter here. The free look on a new individual life policy or annuity is 10 days from delivery (36 O.S. §4003.1(A)), but a replacement carries a separate, longer right: the insurer must guarantee at least a 20-day right to return the policy after delivery for a full refund of premium (36 O.S. §4034(G)). The outline's state-law section also cites the Fair Credit Reporting Act (36 O.S. §§950-959 and 15 U.S.C. §§1681-1681d), which sits behind the consumer-report questions.

These 17 questions come from LanePrep's Oklahoma L&H quiz bank and follow three areas: the application and receipts, delivery and replacement, and the conditions that decide whether a policy is in force.

Count the days before you pick an answer. 10 and 20 are both on the page, and the question usually tells you which transaction you are in.

Practice Questions 1-6: The Application, Corrections and Receipts

Signing for the applicant, the right-to-return period on a replacement annuity, correcting an error on the application, what a producer must not say at delivery, what an investigative report is and what an approval-type conditional receipt covers.

Question 1 (Chapter 5)

An Oklahoma producer is completing an application with a client but realizes the client forgot to sign one of the medical authorization forms. The producer is in a hurry and signs the client's name to save time. This action is:

  • A) Permissible if the client gave verbal permission over the phone.
  • B) A minor administrative error that can be corrected by the insurer's home office.
  • C) A violation of the Oklahoma Insurance Code and may lead to license revocation.
  • D) Acceptable as long as the agent's signature is also present on the form.
Show answer & explanation

Answer: C

Forging a signature on an insurance application or related document is a prohibited act under 36 O.S. §1435.13. Both the applicant and the producer must sign the application personally to verify the accuracy of the information.

Question 2 (Chapter 5)

A producer is helping a client replace an existing annuity. According to 36 O.S. §4034(G), the client must be given a 'right to return' period of at least how many days for a full refund of all premiums paid?

  • A) 10 days
  • B) 30 days
  • C) 45 days
  • D) 20 days
Show answer & explanation

Answer: D

While standard life policies often have a 10-day free look, Oklahoma statute 36 O.S. §4034(G) specifically mandates a twenty (20) day right to return for replacement transactions.

Question 3 (Chapter 5)

An Oklahoma producer is filling out an application and the client makes a mistake while answering a question about their tobacco use. How should the error be corrected?

  • A) The producer should use white-out to cover the error and write the correct answer over it.
  • B) The producer should throw the application away and start a new one, as corrections are never allowed.
  • C) The producer should leave the error as is and attach a separate note explaining the mistake.
  • D) The producer should cross out the error, have the applicant initial the change, and write the correct answer.
Show answer & explanation

Answer: D

If a mistake is made on an application, the best practice is to have the applicant cross out the incorrect information, write the correct information, and initial the change. This proves the applicant was aware of and authorized the correction.

Question 4 (Chapter 5)

An Oklahoma producer is delivering a policy to a client. The producer should do all of the following EXCEPT:

  • A) Advise the client that the free-look period is optional and can be waived for a discount.
  • B) Explain the policy's provisions and riders.
  • C) Collect any due premium.
  • D) Obtain a signed delivery receipt.
Show answer & explanation

Answer: A

The free-look period is a statutory right and cannot be waived by the client or the producer. Explaining the policy and obtaining a delivery receipt are standard professional practices.

Question 5 (Chapter 5)

An investigative consumer report is different from a standard credit report because it:

  • A) Includes interviews with friends, neighbors, and associates of the applicant.
  • B) Is only used for disability income insurance.
  • C) Does not require the applicant's consent.
  • D) Is performed by the Insurance Department instead of a private agency.
Show answer & explanation

Answer: A

Investigative consumer reports gather information on a person's character, general reputation, personal characteristics, and mode of living through personal interviews. Under FCRA, applicants must be notified that such a report may be made.

Question 6 (Chapter 5)

An applicant for a life policy pays the initial premium and receives an 'approval' type conditional receipt. The applicant dies in a car accident one week later. The insurer is still reviewing the medical background and has not yet issued an approval. How will the insurer handle the claim?

  • A) The claim will be paid because the premium was accepted.
  • B) The claim will be paid only if the applicant was in perfect health at the time of the accident.
  • C) The insurer will refund the premium plus 10% interest but deny the death benefit.
  • D) The claim will be denied because the policy was never approved by the underwriter.
Show answer & explanation

Answer: D

With an 'approval' conditional receipt, coverage does not begin until the insurer actually approves the application. This is more restrictive than an 'insurability' receipt, which would have covered the applicant if they were found to be insurable on the date of application.

Practice Questions 7-12: Delivery, Replacement and Testing

Delivery without a face-to-face meeting, whether the replacement procedures apply to a short term policy, what makes a transaction a replacement, a return on day 18, consent to testing and a second approval-receipt case.

Question 7 (Chapter 5)

An agent leaves a policy in the mailbox of an applicant because the applicant was not home. The agent then calls the applicant to confirm it was delivered. This is an example of:

  • A) Physical delivery.
  • B) Illegal delivery.
  • C) Constructive delivery.
  • D) Conditional delivery.
Show answer & explanation

Answer: C

Constructive delivery occurs when the insurer or agent relinquishes control of the policy to a third party or the mail, or when the policy is delivered without a face-to-face meeting, provided all conditions (like premium payment) are met.

Question 8 (Chapter 5)

An applicant wants to replace a 2-year non-renewable term policy with a new whole life policy. The producer tells the applicant that the standard replacement procedures do not apply. Is the producer correct?

  • A) No, all term policies are subject to replacement rules.
  • B) No, because whole life is a permanent form of insurance.
  • C) Yes, but only if the term policy has a face amount under $10,000.
  • D) Yes, non-renewable term policies that expire in 5 years or less are exempt.
Show answer & explanation

Answer: D

36 O.S. §4032 exempts nonconvertible and nonrenewable term life insurance policies which will expire in five years or less from the replacement act requirements.

Question 9 (Chapter 5)

An existing life insurance policy is being re-issued with a reduction in cash value to fund a new policy. This is an example of:

  • A) Replacement.
  • B) Reinstatement.
  • C) Novation.
  • D) Conversion.
Show answer & explanation

Answer: A

Under Oklahoma law, if an existing policy is re-issued with any reduction in cash value to facilitate the purchase of a new policy, it meets the statutory definition of a replacement.

Question 10 (Chapter 5)

A producer is assisting a client in Oklahoma with a life insurance replacement. The client decides to return the new policy 18 days after it was delivered. According to 36 O.S. §4034(G), what is the insurer's obligation?

  • A) The insurer must refund the premium minus a surrender charge.
  • B) The insurer is not obligated to refund anything because the 10-day free look has passed.
  • C) The insurer must refund the premium but may retain the policy fee.
  • D) The insurer must provide a full refund of all premiums paid.
Show answer & explanation

Answer: D

Per 36 O.S. §4034(G) of the Life Insurance and Annuity Policyholders Protection Act, Oklahoma requires a minimum 20-day right to return for replacement transactions for a full refund of premium. This is longer than the standard 10-day free look.

Question 11 (Chapter 5)

Under Oklahoma Administrative Code (OAC) 365:10-5-4, if an insurer requires an applicant to undergo an HIV test during underwriting, what must the insurer obtain?

  • A) A written informed consent form signed by the applicant.
  • B) A verbal confirmation of consent.
  • C) A court order from an Oklahoma district judge.
  • D) A referral from the applicant's primary care physician.
Show answer & explanation

Answer: A

Oklahoma rules require insurers to obtain written informed consent from an applicant before testing for HIV. This form must explain the test and how results will be handled.

Question 12 (Chapter 5)

An applicant for a Life policy in Norman, OK, pays the initial premium and is issued an 'Approval' type conditional receipt. The applicant dies before the insurer has reviewed the application. What is the status of the coverage?

  • A) Coverage is in effect from the date of the receipt.
  • B) Coverage is in effect only if the applicant was insurable.
  • C) No coverage is in effect because the insurer had not yet approved the application.
  • D) Coverage is in effect for 30 days regardless of approval.
Show answer & explanation

Answer: C

An 'Approval' type receipt is restrictive; it states that coverage begins only when the application is actually approved by the company's underwriting department. If the applicant dies before approval, there is no coverage.

Practice Questions 13-17: Insurable Interest, Delivery Conditions and Rated Policies

When insurable interest must exist, what to do when the applicant's health changes before delivery, borrowing against an old policy to buy a new one, what an insurer must and must not do before testing, and delivering a policy issued with a rating.

Question 13 (Chapter 5)

Under Oklahoma law, 'Insurable Interest' in a life insurance policy must exist at what time?

  • A) At the time of the insured's death.
  • B) At the time of policy application.
  • C) Continuously from application until death.
  • D) Only when a claim is filed.
Show answer & explanation

Answer: B

In life insurance, insurable interest must exist at the time the policy is purchased (application). It does not need to exist at the time of death (unlike property insurance).

Question 14 (Chapter 5)

During an application for a life insurance policy in Tulsa, the producer fails to collect the initial premium. The insurer approves the application and issues the policy. When the producer arrives to deliver the policy, the applicant is in the hospital following a minor stroke. What action must the producer take?

  • A) Refuse to deliver the policy and notify the insurer of the change in the applicant's health.
  • B) Deliver the policy and collect the premium, as the insurer already approved the risk.
  • C) Leave the policy with a family member and collect the premium later.
  • D) Collect the premium and a signed Statement of Good Health, then deliver the policy.
Show answer & explanation

Answer: A

If the initial premium is not paid at the time of application, the policy does not take effect until it is delivered and the premium is paid while the applicant is in the same state of health as described in the application. Since the applicant's health has materially changed (stroke), the producer cannot deliver the policy or collect the premium.

Question 15 (Chapter 5)

A producer in Edmond is reviewing a client's existing $200,000 life policy. The producer suggests the client take a maximum loan against the cash value of the old policy to pay the premiums for a new $500,000 policy. Under Oklahoma law, this is defined as:

  • A) Twisting
  • B) Churning
  • C) Replacement
  • D) Conservation
Show answer & explanation

Answer: C

Under 36 O.S. §4033(1), a replacement is any transaction in which a new life insurance or annuity policy is to be purchased and the agent knows or should know that an existing policy has been or is to be lapsed, surrendered, converted, or placed on extended insurance, or that the cash loan value, or any portion of it, is used or contemplated for use with the purchase of the new policy. Borrowing against the old policy's cash value to pay the premiums on the new one is therefore a replacement, which triggers the notice and statement requirements of 36 O.S. §4034. Twisting and churning describe misleading sales practices, not the statutory definition asked about.

Question 16 (Chapter 5)

An Oklahoma insurer requires an applicant to take an HIV test as part of the underwriting for a large life policy. According to OAC 365:10-5-4, the insurer must do all of the following EXCEPT:

  • A) Obtain written informed consent from the applicant.
  • B) Explain that the test is for the presence of HIV antibodies.
  • C) Provide the name of the specific laboratory performing the test.
  • D) Inform the applicant that they may name a physician to receive positive test results.
Show answer & explanation

Answer: C

Oklahoma rules require written informed consent and notification regarding the purpose of the test and the disclosure of results. While the insurer must use a qualified lab, they are not specifically required to name the lab to the applicant in the consent form.

Question 17 (Chapter 5)

A producer is delivering a policy to a client in Stillwater. The policy was issued with a 'rating' due to the client's high blood pressure. What must the producer do at the time of delivery?

  • A) Nothing, the policy is already in force.
  • B) Explain the reason for the rating and collect any additional premium required.
  • C) Collect a new application with the correct premium amount.
  • D) Notify the Medical Information Bureau (MIB) that the policy was issued as rated.
Show answer & explanation

Answer: B

When a policy is issued other than as applied for (e.g., rated), the producer must explain the changes to the applicant and collect the additional premium to put the policy in force. This is often treated as a 'counter-offer' by the insurer.

The Mistakes That Cost Marks

Swapping the 10-day and 20-day periods. The ordinary free look is 10 days from delivery (36 O.S. §4003.1(A)). A replacement carries at least a 20-day right to return for a full refund of premium (36 O.S. §4034(G)), so a client who returns a replacement policy on day 18 is inside the right.

Confusing the two conditional receipts. With an approval-type receipt, coverage begins only when the insurer approves the application, and a death before approval means no coverage. An insurability-type receipt can reach back to the date of application if the applicant proves insurable.

Delivering into a change in health. When the initial premium was not paid with the application, the policy takes effect on delivery and payment only if the applicant's health is as described in the application. If it has materially changed, the producer does not deliver and notifies the insurer.

Treating replacement as only a surrender. A replacement can also be a policy reissued with a reduction in cash value, or an old policy's cash value used to pay for the new one.

Editing the application the wrong way. The producer never signs for the applicant. A mistake is corrected by crossing it out, writing the right answer and having the applicant initial the change. A rated policy is explained at delivery and any additional premium is collected.
